Terms & Agreement

Scheduling & Attendance

  • Training sessions begin at their scheduled start time.

  • Clients arriving late will receive the remainder of their scheduled session. Sessions will not be extended dueto client lateness.

  • For sessions beginning before 10:00 AM, clients have a 10-minute grace period. If a client has not arrived orcommunicated within 10 minutes of the scheduled start time, the session will be considered a no-show.

  • For sessions beginning at or after 10:00 AM, clients have a 15-minute grace period. If a client has notarrived or communicated within 15 minutes of the scheduled start time, the session will be considered a no-show.

  • If the trainer is delayed, every effort will be made to provide the full session length. Time may be added tothe current session when scheduling permits or credited toward a future session.

  • Clients are responsible for arriving prepared and ready to train at the scheduled appointment time.

Cancellation & No-Show Policy

  • A minimum of 24 hours' notice is required to cancel or reschedule a session.

  • Each client receives one Quarterly Flex Pass per calendar quarter. This pass may be used for one of thefollowing:

    • A missed session

    • A cancellation made within the 24-hour cancellation window

    • A last-minute scheduling conflict

  • Unused Flex Passes do not roll over into future quarters and may not be accumulated.

  • Once the Quarterly Flex Pass has been used, any additional cancellations within 24 hours or no-shows willresult in the session being deducted from the client's package.

  • Oversleeping, forgetting an appointment, work obligations, transportation issues, calendar errors, or otherpersonal scheduling conflicts do not exempt a client from this policy.

  • If the trainer arrives at the agreed-upon training location and the client is unavailable, the session will beconsidered a no-show.

Session Packages & Expiration

  • All package purchases are non-refundable.

  • Package expiration dates are calculated from the purchase date and are as follows:

    • 6-session duo package: expires 3 months from purchase date

    • 8-session package: expires 4 months from purchase date

    • 10-session package: expires 4 months from purchase date

    • 12-session package: expires 4 months from purchase date

    • 24-session package: expires 4 months from purchase date

    • 16-session package: expires 6 months from purchase date

  • Unused sessions expire at the conclusion of the package term unless otherwise approved in writing.

  • Sessions are intended to be used within the timeframe associated with the purchased package. Missed sessions do not automatically extend a package's expiration date.

  • Packages and reserved training times are non-transferable between calendar weeks and may not be carried forward beyond the package expiration date unless otherwise approved in writing by Human Magic.

  • Clients are responsible for scheduling and utilizing their sessions within the package term. Unused sessions remaining after the expiration date are forfeited.

  • Clients experiencing injury or medical circumstances may request a package pause of up to two months with trainer approval.

  • Pregnancy does not automatically qualify for a package pause, as prenatal training services are available through Human Magic.

Session Transfers

  • Training packages may not be shared between individuals.

  • Unused sessions may be transferred to another person for a $120 transfer fee, which covers the new client's assessment, intake process, and program setup.

  • The trainer reserves the right to approve or decline transfer requests.

Payment Policy

  • Payment is due on or before the first scheduled session and must be received prior to training beginning.

  • Clients may choose one of the following payment options:

    • Pay in Full

      • The entire package balance is due before the first session.

    • Payment Plan

      • Clients may pay half of the package cost plus $100 prior to the first session.

      • The remaining balance must be paid before the sixth session begins.

      • Failure to complete payment by the required deadline may result in suspension of future sessions until payment is received.

      • As Human Magic transitions to automated billing systems, clients may be required to keep a valid payment method on file for scheduling and payment processing purposes.

      • Rates and package pricing are subject to change with advance notice.

Communication

  • Text messaging is preferred for scheduling matters, cancellations, and time-sensitive communication.

  • Email is preferred for written programs, progress updates, educational materials, and detailed feedback.

  • Messages received after 10:00 PM will generally be answered the following business day.

  • Response times may vary during weekends, holidays, vacations, or periods of high client volume.

Custom Programs & Intellectual Property

  • Custom training programs, workout plans, educational materials, and written content provided by Human Magic are intended solely for the purchasing client.

  • Clients may not reproduce, distribute, sell, publish, share, or otherwise provide these materials to another individual without written permission.

  • Written programs provided via email remain available to the client for personal use.

Health & Safety

  • Clients are responsible for informing the trainer of any changes in health status, including but not limited to:

    • Injuries

    • Illnesses

    • Pregnancy

    • Surgeries

    • Medications

    • Medical restrictions

  • The trainer reserves the right to modify, postpone, or terminate any session if participation appears unsafe or inappropriate for the client's current condition.

  • Clients participate voluntarily and assume responsibility for communicating physical discomfort, pain, dizziness, or other concerns during training.

Weather, Travel & Facility Access

  • In cases of severe weather, transit disruptions, emergencies, or other circumstances beyond either party's control, sessions may be rescheduled without penalty.

  • The trainer will communicate updates as early as reasonably possible when travel conditions may affect appointments.

  • If a training facility, gym, or building amenity space becomes unexpectedly unavailable, the client agrees to notify the trainer as soon as possible.

  • When appropriate and mutually agreed upon, sessions may be modified and conducted using bodyweight exercises or alternative training methods in the client's residence.

Recurring Appointment Policy

  • Clients who train on a recurring schedule are reserving dedicated time within the trainer's calendar.

  • Recurring appointments are held exclusively for the client and are not made available to other clients during that reserved time.

  • To maintain a recurring time slot, clients are expected to attend sessions consistently, communicate schedule changes in accordance with the cancellation policy, and remain current on all payments.

  • Human Magic reserves the right to release a recurring appointment time if attendance becomesinconsistent, cancellations become excessive, payment obligations are not met, or communicationrepeatedly falls outside the agreed-upon policies.

  • Should a recurring time slot be released, clients are welcome to continue training based on availability butmay not be guaranteed their previous appointment time.

Professional Scope of Practice

  • Human Magic provides fitness, movement, wellness, and lifestyle coaching services within the trainer's scope of education and certification.

  • Services provided are not a substitute for medical advice, diagnosis, treatment, physical therapy, mentalhealth counseling, or other licensed healthcare services.

  • Clients are encouraged to consult their physician or healthcare provider regarding any medical concernsbefore beginning or continuing an exercise program.
